§ 1 General Provisions

These Terms and Conditions govern rental agreements concluded between RIDE EASY sp. z o.o. with its registered office in Gdańsk, through the website ride-easy.rent and by other means of communication.

These Terms and Conditions apply to all such rental agreements unless otherwise provided in the content of a given agreement. In the event of any discrepancies between the concluded rental agreement and these Terms and Conditions, the parties shall be bound by the rental agreement.

Whenever these Terms and Conditions refer to the Lessor, Lessee, Motorcycle, Online Portal, Reservation, Agreement, Party / Parties, User, Consumer, Rental Price, Table of Fees, Additional Charges, Reservation Fee, Replacement Motorcycle, Business Days, Collision, or Documentary Form, these expressions shall have the meanings assigned to them in the original Terms and Conditions document.

§ 2 Conditions for Concluding the Agreement

  1. To become a Lessee, a natural person must be at least 18 years old, hold a valid category A driving licence recognized in Poland, not be subject to any driving ban, present a valid identity card or passport, possess a valid card or bank account, and have an active mobile phone number.
  2. A User may only be a person who meets the required eligibility conditions.
  3. Where the Lessee is an entrepreneur, the Lessor may require current company registration documents and related corporate documents.
  4. The required conditions must remain fulfilled throughout the entire duration of the Agreement.
  5. The Lessor may verify compliance with these conditions before concluding the Agreement.
  6. The Agreement is concluded in writing, except for Reservations, no later than on the day the Motorcycle is handed over.
  7. The Agreement attachments include these Terms and Conditions, the Table of Fees, the Motorcycle user manual, general terms of use, and the handover and return protocol.
  8. By concluding the Agreement, the Lessee confirms acceptance of the Agreement and these Terms and Conditions.
  9. The Agreement enters into force on the date indicated in the Agreement or on the date of handover.
  10. The Agreement is concluded for a fixed term and may be extended according to the procedure described in the Terms and Conditions.
  11. The Motorcycle is handed over on the basis of a signed protocol, and the Lessor may refuse handover in situations defined in the Terms and Conditions.
  12. The Lessee is obliged to pay a deposit if required by the Agreement.

§ 3 Conditions for the Use of the Motorcycle

  1. The Motorcycle may be operated only by the Lessee or an approved User.
  2. The Lessee and User must carry required documents, properly secure the Motorcycle, perform daily maintenance, use correct fuel, keep the Motorcycle reasonably clean, comply with road regulations, and use the Motorcycle in accordance with its intended purpose and the Agreement.
  3. It is prohibited to use the Motorcycle in ways described in the Terms and Conditions as forbidden, including unauthorized repairs or alterations, racing, misuse, transport of prohibited loads, or use by unauthorized persons.
  4. Travel outside Poland requires prior consent of the Lessor.
  5. The Lessee acknowledges that the Motorcycle may be equipped with GPS location tracking.

§ 4 Lessee’s Liability

  1. The Lessee is responsible for use of the Motorcycle contrary to the Agreement or applicable law, including acts or omissions of the User.
  2. Consumers are liable on the basis of fault, while non-consumer Lessees may be liable on the basis of risk unless otherwise stated.
  3. The Lessee is not liable for ordinary wear and tear resulting from proper use.
  4. The Lessee or User bears responsibility for fines, tickets, and penalties arising from traffic law violations.
  5. The Lessor may charge Additional Fees in the circumstances described in the Agreement and Table of Fees.
  6. The Lessee may be obliged to cover repair costs, deductible amounts, and other damage-related costs in accordance with the Terms and Conditions.

§ 5 Lessor’s Liability

  1. The Lessor is liable under the Agreement in accordance with the Civil Code and within the limits described in the Terms and Conditions.
  2. The Lessor is not liable for lost profits or non-material damage unless caused by willful misconduct.

§ 6 Return of the Motorcycle and Terms of Rental Termination

  1. The Lessee must return the Motorcycle at the place and time specified in the Agreement unless another arrangement is accepted by the Lessor.
  2. Return at a different location may require additional payment.
  3. The Motorcycle must be returned in proper condition, with the proper fuel level, documents, and keys, taking into account ordinary wear and tear.
  4. Serious delay in returning the Motorcycle may be treated as unlawful appropriation and reported to the authorities.
  5. The Agreement may be terminated by either party in cases specified in the Terms and Conditions.
  6. The Terms and Conditions also regulate withdrawal, cancellation, replacement motorcycles, refunds, and consequences of non-delivery.

§ 7 Servicing, Breakdowns, Collisions, and Repairs

  1. The Lessee must allow inspection of the Motorcycle where justified under the Agreement.
  2. If inspection or servicing is needed, the Lessee must follow the Lessor’s instructions regarding delivery of the Motorcycle.
  3. In the event of breakdown or collision, the Lessee must secure the situation, notify emergency services if required, immediately inform the Lessor, stop using the Motorcycle, avoid independent repairs, and follow further instructions.
  4. Repairs may only be carried out upon the Lessor’s instruction.
  5. The rules for replacement motorcycles and cost responsibility depend on the cause of the breakdown or damage, as set out in the Agreement.

§ 8 Fees – Rental Price, Additional Charges, Operating Costs

  1. The Lessee is obliged to pay the Rental Price specified in the Agreement.
  2. The Lessee also bears operating costs such as fuel, cleaning, oil, chain lubrication, tolls, parking, and similar everyday costs of use.
  3. The Lessor may charge Additional Fees and other sums due under the Agreement and Table of Fees.
  4. Payment may be made in cash, by transfer, or by payment card, depending on the agreed method.
  5. Late payment may result in statutory interest for delay.
  6. The Rental Price may be proportionally reduced for periods when the Motorcycle was unusable for reasons not attributable to the Lessee.

§ 9 Conditions for Making Reservations

  1. Reservations may be made through the Online Portal or by telephone.
  2. A successfully completed Reservation is equivalent to the conclusion of the Agreement.
  3. A Reservation is completed after payment is made and confirmation is received.
  4. If payment is not made in time, the Reservation process is ineffective unless the Lessor grants additional time.
  5. The Lessee must provide a functioning email address and correct contact details.
  6. The detailed online and phone Reservation steps are governed by the Terms and Conditions.

§ 10 Complaints

  1. The Lessee may file a complaint concerning irregularities in the Reservation process or improper performance of the Agreement.
  2. The complaint should include identification details, a description of the matter, supporting circumstances, and relevant Agreement information.
  3. Complaints may be submitted in writing or electronically to info@ride-easy.rent.
  4. The Lessor should respond within 30 days, subject to the rules described in the Terms and Conditions.

§ 11 Final Provisions

  1. Final provisions regarding applicable law, court jurisdiction, personal data processing, form of amendments, severability, and availability of the Terms and Conditions are governed by the original document.
